It is unusual for a federal agency to publicly attack another agency’s proposal. “Advocacy advises the agencies to withdraw the rule,” SBA wrote in a letter to EPA Administrator Gina McCarthy. “The rule will have a direct and potentially costly impact on small businesses.”
Our Federal Affairs Committee believes that this issue will become a litigated, “win/lose” situation without the involvement of state and local governments. This includes state and local agencies responsible for water quality regulations, agricultural interests, municipalities, special districts and environmental interests, and utility groups.
The new deadline for comments on the rule has been extended to November 14. The Colorado Water Congress Federal Affairs Committee is working to prepare a formal set of comments.
